This includes the commercial register or the trade register entry of the Polish company. Ask for an extract from the trade register and the commercial register. Should a Polish subcontractor fail to comply with the obligation of registering their employees, they run a high risk of conducting illegal employment. An unregistered Polish subcontractor then works illegally in Germany and is liable to prosecution. A valid exemption certificate under § 48b of the German Income Tax Act (EStG) relieves the client from the obligation to withhold the construction withholding tax of 15% of the remuneration and remit it to the tax office.
