Legal requirements for subcontractors from Poland

Before hiring Polish subcontractors, the legal basis should be checked. This includes the commercial register or the trade register entry of the Polish company. Ask for an extract from the trade register and the commercial register. Furthermore, you as the client should check whether the subcontractor from Poland pays his taxes and social security contributions. If a Polish subcontractor already fails to pay his taxes and social security contributions, this increases the risk that he will be in a bad financial situation. In that case, you should rather look for other subcontractors from Poland or Eastern Europe. Ask the Tax Office in Poland for a clearance certificate to determine whether the Polish contractor has fulfilled his payments and obligations.

A1 certificates for Polish construction workers

For employees from Poland, the social security obligation applies after a period of more than 24 months if they are working as subcontractors from Poland. A Polish employee who wants to work in Germany must have a valid A1 certificate as proof of insurance. These certificates are very important and mandatory for clients in Germany. If social security contributions have not been paid, German clients can be held liable. In such cases, they are required to pay the social security contributions in Germany. If a Polish subcontractor fails to meet these obligations, the liability does not fall on them but on their German client.

Notification of subcontractors from Poland to customs

When a Polish subcontractor sends his workers from Poland to Germany, he must report this electronically to the customs administration office. The following information is provided to the customs administration office: the place of employment, the duration and the start of employment as well as the names of each individual employee. Should a Polish subcontractor fail to comply with the obligation of registering their employees, they run a high risk of conducting illegal employment. An unregistered Polish subcontractor then works illegally in Germany and is liable to prosecution. For this reason, clients should check with their employees before employing them to ensure that everyone has been registered correctly.

Exemption certificate for construction work

A valid exemption certificate under § 48b of the German Income Tax Act (EStG) relieves the client from the obligation to withhold the construction withholding tax of 15% of the remuneration and remit it to the tax office. Without this certificate, the client is required to make this tax deduction. Therefore, it is important for German clients to check the validity of the exemption certificate before hiring a subcontractor from Poland and, if necessary, apply for a follow-up certificate.

Clearance certificate from the health insurance company

In the area of social security, there is also the possibility to apply for certificates confirming the fulfilment of reporting and payment obligations on the part of the client. This is particularly important in the case of possible liability of subcontractors.

If you as a building contractor are therefore requested to submit clearance certificates from the health insurance fund or the statutory accident insurance fund, simply apply for these from the relevant health insurance fund or accident insurance fund. In most cases, this is also possible online.
